Moto Acquire LLC (“MotoAcquire,” “we,” “us,” or “our”) provides automotive software solutions for dealerships and consumers.

We are based in Chicago, Illinois, and operate as a U.S.-based company.

2. Scope of These Terms

These Terms apply to all users of MotoAcquire websites and tools, including:

• Visitors to MotoAcquire.com

• Consumers using dealer-branded tools powered by MotoAcquire

• Visitors or customers of MotoInsite.com

Each section below explains how these Terms apply depending on which product or site you’re using.

3. MotoAcquire.com (Marketing Website)

Purpose.

MotoAcquire.com provides information about our company, products, and services.

Use of Content.

You may browse the site and use its content for informational purposes only.

All content, including text, graphics, logos, and software, is owned or licensed by MotoAcquire and protected under copyright and trademark laws.

Prohibited Conduct.

You agree not to:

• Copy or reuse our site materials without permission.

• Attempt to disrupt, hack, or misuse the site.

4. Dealer-Branded Tools Powered by MotoAcquire

MotoAcquire provides software and hosting for dealers who offer valuation, firm offer, or trade-in experiences to their customers.

When you use one of these tools (for example, sellmycar.dealername.com), you are interacting with a dealer-branded tool powered by MotoAcquire.

Your Relationship With the Dealer.

• The dealership whose brand appears on the tool is responsible for any vehicle valuations, follow-ups, or communications that result from your submission.

• MotoAcquire is the technology provider, not the buyer or seller of any vehicle.

• Dealers are solely responsible for the accuracy of valuations, offers, and communications.

Data Handling.

• Your information is collected by MotoAcquire on behalf of the dealership and shared securely with that dealership’s CRM or lead management system.

Disclaimer.

MotoAcquire makes no warranties about the availability, accuracy, or reliability of any dealer-provided valuation or offer.

We provide the software “as is” without warranties of any kind, express or implied.

5. MotoInsite.com (Consumer Tools and Insights)

MotoInsite.com provides consumer tools for tracking vehicle value, insights, and related services.

MotoAcquire may also offer optional paid features or subscriptions through this platform.

Account and Payments.

• You must be at least 18 years old to create an account or make a payment.

• Payments are processed securely through Stripe. MotoAcquire does not store credit card information.

• By submitting payment information, you authorize MotoAcquire (and Stripe) to process your payment according to the selected plan or product.

Refunds and Cancellations.

Unless otherwise stated, all payments are non-refundable.

Subscription users may cancel future billing anytime through their account or by contacting support@motoacquire.com.

Permitted Use.

You may use MotoInsite.com and related tools for personal, non-commercial purposes only.

You may not reverse-engineer, resell, or exploit the software.

Third-Party Links and Partners.

MotoInsite may display or link to third-party services, such as insurance or warranty providers.

These links are provided for convenience only.

When you click a link to a third-party site, you leave MotoInsite.com and are subject to that site’s own terms and privacy policy.

MotoAcquire does not control, endorse, or assume responsibility for any third-party content, products, or services.

Dealers using MotoAcquire products retain ownership of their own logos and brand assets.

• The quality or outcome of any valuation, offer, or transaction.

To the maximum extent permitted by law, MotoAcquire and its affiliates, officers, employees, or partners are not liable for:

• Any indirect, incidental, or consequential damages.

• Any loss of profits, data, or goodwill.

• Any claim related to a dealer’s valuation, offer, or communication.

Our total liability in any case will not exceed the amount you paid (if any) to MotoAcquire in the twelve months prior to the claim.

9. Changes to the Services or Terms

We may update or modify these Terms or any part of our Services at any time.

If we make material changes, we’ll update the “Last Updated” date on this page.

By continuing to use our Services after changes are posted, you agree to the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles.

Any disputes will be handled in the state or federal courts located in Cook County, Illinois.
