Moto Acquire LLC (“MotoAcquire,” “we,” “us,” or “our”) provides automotive software solutions for dealerships and consumers.

We are based in Chicago, Illinois, and operate as a U.S.-based company.

• Consumers using dealer-branded tools powered by MotoAcquire

Note for dealerships: if you are a dealership subscribing to MotoAcquire products, your subscription is governed by our Dealer Terms & Conditions.

The Services are intended for users who are at least 18 years old or the age of majority in your state.

3. MotoAcquire.com (Marketing Website)

Purpose.

MotoAcquire.com provides information about our company, products, and services.

Use of Content.

You may browse the site and use its content for informational purposes only.

All content, including text, graphics, logos, and software, is owned or licensed by MotoAcquire and protected under copyright and trademark laws.

Prohibited Conduct.

You agree not to:

4. Dealer-Branded Tools Powered by MotoAcquire

MotoAcquire provides software and hosting for dealers who offer valuation, firm offer, or trade-in experiences to their customers.

When you use one of these tools (for example, sellmycar.dealername.com), you are interacting with a dealer-branded tool powered by MotoAcquire.

When you submit information through these tools, you agree to provide accurate and complete information about yourself and your vehicle.

Your Relationship With the Dealer.

• The dealership whose brand appears on the tool is responsible for any vehicle valuations, follow-ups, or communications that result from your submission.

• MotoAcquire is the technology provider, not the buyer or seller of any vehicle.

• Dealers are solely responsible for the accuracy of valuations, offers, and communications.

Data Handling.

• Your information is collected by MotoAcquire on behalf of the dealership and shared securely with that dealership’s CRM or lead management system.

Disclaimer.

MotoAcquire makes no warranties about the availability, accuracy, or reliability of any dealer-provided valuation or offer.

We provide the software “as is” without warranties of any kind, express or implied.

5. Intellectual Property

All trademarks, logos, product names, and designs on our websites and tools are the property of MotoAcquire or our licensors.

You may not use them without written permission.

Dealers using MotoAcquire products retain ownership of their own logos and brand assets.

6. Disclaimers

The Services are provided “as is” and “as available.”

MotoAcquire makes no representations or warranties, express or implied, regarding:

• The accuracy or reliability of any information.

• Continuous or error-free operation.

• The quality or outcome of any valuation, offer, or transaction.

You use our Services at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, MotoAcquire and its affiliates, officers, employees, or partners are not liable for:

Our total liability in any case will not exceed the amount you paid (if any) to MotoAcquire in the twelve months prior to the claim.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

All the above categories exclude text messaging originator opt-in data and consent;

this information will not be shared with any third parties.

9. Changes to the Services or Terms

We may update or modify these Terms or any part of our Services at any time.

If we make material changes, we’ll update the “Last Updated” date on this page.

By continuing to use our Services after changes are posted, you agree to the updated Terms.

10. Governing Law and Miscellaneous

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles.

Any disputes will be handled in the state or federal courts located in Cook County, Illinois.
